Terms and Conditions

The contractual conditions governing access to and use of SolvTako, the marketplace connecting people who offer and seek local services.

1. Identification and acceptance

These Terms and Conditions govern access to and use of the SolvTako website and application, owned by SolvTako, S.L. (Sociedad de Responsabilidad Limitada), Spanish Tax ID (NIF) B88978887, with registered office at Avenida Ribados, 14B, 2C, 15670, Culleredo, A Coruña, España.

By registering or using the service you confirm that you have read and accept these Terms and Conditions and the Privacy Policy. If you do not agree with them, you must refrain from using the service.

2. Purpose and scope

These Terms govern the conditions of access to and use of the SolvTako marketplace, including the publication of offers and requests, communication between users, rating systems and subscription features.

During the prelaunch phase, some features may be limited, evolving or available only to certain regions or users.

3. Definitions

For the purposes of these Terms:

  • Platform: the SolvTako website and application and associated services.
  • User: any person who accesses or registers on the Platform.
  • Provider: a user who offers a service through the Platform.
  • Requester: a user who seeks or requests a service through the Platform.
  • Listing: a job offer or service request created by a user.
  • Content: any text, image, rating, message or material contributed by users.

4. Nature of SolvTako as a marketplace

SolvTako is a marketplace platform that facilitates contact between Providers and Requesters of local services. SolvTako is not an employer, staffing company, placement agency or labour intermediary, and is not a party to the contracts or agreements entered into between users.

SolvTako does not guarantee that users will actually contract with one another, nor the quality, suitability, legality, safety or availability of the services listed, which are the sole responsibility of those who offer and contract them.

5. Account registration and authentication

To use certain features you must create an account through our identity provider. You are responsible for keeping your credentials confidential and for all activity carried out from your account.

  • You must provide truthful, accurate and up-to-date information.
  • You must be at least 18 years old to register and use the service.
  • You may not transfer your account or allow its use by unauthorised third parties.

6. Accuracy of the information provided

Users are solely responsible for the truthfulness, accuracy and lawfulness of the information they provide, whether in their profile or in their listings, messages and ratings. Inaccurate, misleading or fraudulent information may result in the removal of content or the suspension of the account.

7. Publication of offers and requests

Users may create job offer or service request listings within the available categories. Listings must be lawful, truthful and compliant with these Terms and with the Safety and Community Guidelines.

8. Categories, prices, availability and conditions published

The categories, prices, availability and conditions of services are set freely by each user. Prices published do not constitute an official SolvTako rate or advice on the appropriate amount for a service.

9. Relationship between users

Any agreement concerning a service is entered into privately and exclusively between the interested users. SolvTako does not take part in the negotiation, contracting, price, quality, payment or performance of such services.

Users are responsible for complying with the labour, tax, immigration, social security and administrative rules applicable to their activity.

10. Exclusion of employment, agency or representation

Nothing in these Terms creates an employment, agency, representation, partnership or joint-venture relationship between SolvTako and users, or between users themselves, merely from use of the Platform.

11. Messaging, communications and notifications

The Platform provides users with messaging and notification tools. Communications must respect other people and the Safety and Community Guidelines. Abusive, fraudulent or unlawful content may be removed.

12. Reputation, ratings and references

The Platform offers rating and reference systems between users. Ratings must be truthful and based on real experiences. Manipulating reputation through false, improperly incentivised or retaliatory ratings is prohibited.

13. Identity verification

Where the Platform offers identity verification processes, these may be partial or optional. Verification does not guarantee the absence of risk nor the conduct, solvency or suitability of any user, who must exercise their own diligence at all times.

14. Subscriptions and in-app purchases

Subscriptions and in-app purchases are handled through the Apple App Store or Google Play, subject to their respective terms.

  • The final price, taxes, currency and promotions are displayed and managed in the relevant store.
  • Premium features are enabled while the subscription is active.
  • Apple and Google act as responsible for billing and for managing payment methods.

15. Renewal, cancellation, plan changes and store limitations

Subscriptions may renew automatically in accordance with the terms of the relevant store. Cancellation and plan changes are made from your Apple account (App Store Subscriptions) or Google Play account (Subscriptions).

Refunds are subject to Apple's and Google's policies. Deleting your SolvTako account does not automatically cancel a subscription managed by Apple or Google; you must cancel it in the store if applicable.

16. Organisations, members and licences

Organisations allow several users to be grouped under a single entity. Organisation subscriptions work through licences assignable to their members. The person administering the organisation is responsible for managing its members and assigning licences in accordance with these Terms.

17. Prohibited conduct

The following is prohibited, by way of example and without limitation:

  • Publishing false, misleading, discriminatory, unlawful, defamatory content or content that infringes third-party rights.
  • Using the Platform for fraudulent activities, harassment, exploitation or sexual or unlawful content.
  • Impersonating another person or entity.
  • Circumventing security, moderation or service-limitation measures.
  • Collecting other users' data without a legitimate basis.

18. User-generated content

Users are solely responsible for the Content they publish. By publishing Content, you declare that you hold the necessary rights and grant us a limited, non-exclusive, royalty-free licence to host and display it within the service for the purpose of providing it.

19. Moderation, suspension and removal

SolvTako may review, moderate, remove or restrict Content, and suspend or close accounts that breach these Terms, engage in fraudulent use or put other users or the service at risk. You may also report listings, messages or users, and block other users from their profile or from a conversation.

20. Intellectual and industrial property

The Content you publish remains yours. The brand, design, software, databases and other elements of SolvTako belong to their owner or licensors and may not be reproduced, distributed or transformed without authorisation.

21. Acceptable use of the Platform

You must use the Platform in accordance with the law, these Terms and the Safety and Community Guidelines, refraining from any use that harms its operation, its security or the rights of third parties.

22. Availability, maintenance and changes to the service

The service is provided "as is" and "as available". We do not guarantee uninterrupted or error-free operation, and we may modify, suspend or discontinue features for technical, security or product-evolution reasons.

23. Disclaimer of warranties

To the extent permitted by law, SolvTako makes no warranties as to the suitability, quality, safety, legality or availability of the services listed by users, nor as to the results you may obtain from using the Platform.

24. Limitation of liability

To the extent permitted by law, SolvTako shall not be liable for damages arising from agreements between users, from Content published by third parties or from use of the service. Nothing in these Terms excludes or limits liabilities that cannot be excluded or limited by law, including the rights that consumer law grants to consumers.

25. Liability for external agreements

Users assume full responsibility for the agreements they enter into with one another, including payments, service performance and compliance with applicable legal obligations, without any involvement or guarantee from SolvTako.

26. Protection of minors and vulnerable people

The service is intended for people aged 18 or over. Users must act with special diligence where a service may affect minors or vulnerable people, and comply with the applicable protection rules.

27. Security and fraud prevention

SolvTako may take measures to prevent fraud, abuse and misuse of the Platform, including the verification of certain activities and the limitation or suspension of accounts where there are reasonable indications of non-compliance.

29. Prelaunch and founder rewards

Prelaunch campaign rewards consist solely of subscription benefits; they do not include cash or payments. These rewards are subject to the campaign conditions and may change or end.

30. Changes to the Terms

We may amend these Terms to reflect legal, technical or service changes. We will publish the version in force with its effective date and, where the change is material, we will inform you and may require your acceptance in order to continue using the service.

31. Term, termination and effects of closure

These Terms apply while you use the service. You may stop using it and request deletion of your account at any time. Termination does not affect obligations already arisen or clauses that by their nature must survive.

32. Data protection

The processing of users' personal data is governed by the SolvTako Privacy Policy, in accordance with Regulation (EU) 2016/679 (GDPR) and Spanish data protection law.

33. Dispute resolution and consumers

If you are a consumer resident in the European Union, you have the rights granted to you by consumer protection law. The European Commission provides an online dispute resolution platform which can be found on its official website.

34. Governing law and jurisdiction

These Terms are governed by the law of España, without prejudice to the mandatory consumer-protection rules of the user's country of habitual residence within the European Union. For the resolution of any dispute, the parties submit to the courts and tribunals having jurisdiction under that law.
